These terms govern your use of HelloMe, the messaging app published by GRACELAB OPEN TECH SARL: the mobile app, the https://hello-me.net website and every service attached to them.
By creating an account or using the service, you accept these terms. If you do not accept them, do not use HelloMe. We wrote them to be read: each section says one thing, in plain words, with no traps.
1.What HelloMe is
HelloMe is a communication service: written messages, voice notes, photos, videos, documents, audio and video calls, groups, channels, communities, disappearing status updates and organising tools such as scheduled messages or messages that disappear.
The service changes over time. We add, change and remove features to improve HelloMe, fix flaws or comply with the law. When a change matters to you, we tell you in the app or by another reasonable means.
HelloMe is not an emergency service. It replaces neither emergency numbers nor a phone carrier: do not use HelloMe to reach the emergency services.
2.Who can use the service
You must be at least 13 years old to create an account. If the law of your country sets a higher age to consent to the processing of your data or to enter into this kind of agreement, that age applies instead. A minor must use HelloMe with the agreement of the person holding parental authority.
You must be able to enter into a contract and must not be barred from using the service, in particular following an account closure we decided or a measure imposed by a competent authority.
You may use HelloMe personally or professionally, but always in your own name: you do not create an account on behalf of someone else without their agreement, and you do not resell access to the service.
3.Your account
Creating an account requires a valid phone number, a display name and, depending on the method you choose, an email address and a password or a PIN. This information must be accurate and kept up to date: it is how your contacts recognise you and how you can recover your account.
Your account is personal. You are responsible for your password, your PIN, the verification codes you receive on WhatsApp or by SMS, and the devices connected to your account. Never give a verification code to anyone, including someone claiming to be part of the HelloMe team: we never ask for these codes.
If you lose control of your account or see a login you do not recognise, sign the device out from the settings and write to us straight away at support@gracelab.io.
An account left unused for a long period may be deleted, along with the data attached to it, so that information nobody uses is not kept forever. The period we apply is given in the privacy policy.
4.Your content
What you write, record, photograph or share on HelloMe belongs to you. We claim no ownership over your content and we do not use it for advertising.
So that the service works, you allow us only to host, transmit, display, convert and reproduce your content as far as necessary to deliver it to the recipients you choose, to display it on your devices and to keep the service secure. This permission is limited to that operation and ends when the content is deleted, subject to the technical delays described in the privacy policy.
You warrant that you hold the rights needed over what you share, and you remain responsible for what you send, including when you forward someone else's content.
5.What you agree not to do
The acceptable use rules set out the behaviour that is forbidden. They form part of these terms and must be followed at all times.
- Do not post or send illegal content, in particular child sexual abuse material, calls to violence or hatred, threats, harassment or terrorist content.
- Do not impersonate another person, a company or an institution, and do not mislead the people you talk to about who you are.
- Do not send unsolicited bulk messages, scams, chain messages, malware or fraudulent links.
- Do not harvest other users' data, do not automate access to the service without our written agreement, and do not get around its technical limits or its security measures.
- Do not harm the service: no attacks, no deliberate overloading, no reverse engineering beyond what the law expressly allows.
6.Reports, moderation and penalties
Anyone can report a message, an account, a group or a channel from the app. Reports are reviewed by our team, who may look at the reported material to decide what happens next.
Depending on how serious and how repeated the behaviour is, we may remove content, restrict a feature, suspend an account or close it permanently. We favour the most measured step available, but a serious breach — especially one that targets minors or the safety of others — leads to immediate closure and, where appropriate, a report to the competent authorities.
If a decision seems unjustified to you, write to support@gracelab.io with your phone number and the date of the measure: a person will review it again.
7.The assistant and artificial intelligence features
HelloMe offers optional assistance features: answering an @bot mention, summarising a conversation, suggesting replies, drafting a message for you, correcting or translating what you write, and — if you turn it on — replying automatically while you are away.
These features rely on language models supplied by a third-party provider. They can be wrong, invent a detail or misread a situation. You remain responsible for every message sent from your account, including when it was drafted or sent by the assistant at your request. Read it again before sending.
Replies sent automatically on your behalf are marked as such in the conversation, on both sides. The assistant never reads a conversation set to advanced privacy. Usage limits, retention periods and the detail of what is sent to the provider are given in the privacy policy.
The assistant is not a substitute for any professional. Its answers are not legal, medical or financial advice.
8.Third-party services
HelloMe relies on third-party services to work: your carrier for the data connection, providers for sending verification codes, notifications, audio and video calls and the assistance features. Their role is described in the privacy policy.
Your carrier may charge you for data, SMS or calls. Those costs are yours. In the same way, when a link shared in a conversation takes you to a third-party site or app, that third party's terms apply, and we are not answerable for its content.
9.Availability of the service
We work to keep HelloMe available and fast, but we do not guarantee uninterrupted operation. Maintenance, incidents, network outages or a decision by an authority may make the service unavailable in whole or in part.
We may interrupt or discontinue a feature, and, if we had to shut the service down, we would tell you in advance by any reasonable means so that you could retrieve what matters to you.
10.Our intellectual property
The HelloMe name, its logo, its interfaces, its texts, its illustrations and its software are protected. We grant you a personal, limited, non-exclusive and revocable right to use the app as it is provided.
You do not copy, modify or distribute our software beyond what the law allows, and you do not use our brand to suggest an official connection that does not exist.
11.Price
HelloMe is free for individuals. Some offers for businesses or some advanced features may become paid: if that happens, the price, the term and the cancellation conditions will be shown to you clearly before any payment, and nothing will be charged without your express agreement.
12.Warranties and liability
The service is provided as is. To the extent the law allows, we do not guarantee that it will be free of errors, that it will meet a particular purpose or that a message will always be delivered instantly.
We are liable for damage caused by a failure on our part under the conditions set by law. We are not liable for content posted by users, for the use you make of the service, for access obtained because a password was poorly protected, or for indirect damage such as loss of business or loss of opportunity.
Nothing in these terms limits the rights the law gives you as a consumer, nor our liability in cases of gross negligence, wilful misconduct or harm to a person's physical integrity.
13.End of the agreement
You can stop using HelloMe at any time and delete your account from the app. The "Delete your account and data" page explains what is deleted and within what time.
We may suspend or close your account if you seriously breach these terms or the acceptable use rules, if the law requires it, or if keeping the account open poses a serious risk to other people or to the service. Except in an emergency or where the law requires otherwise, we tell you the reason and how to challenge it.
14.Changes to these terms
We may change these terms, for example when the service changes or the law evolves. The date of the last update is shown at the top of this page.
For a substantial change, we tell you at least thirty days before it takes effect, unless the change has to apply immediately for legal or security reasons. Continuing to use HelloMe after that date counts as acceptance; otherwise, you can delete your account.
15.Governing law and disputes
We look for an amicable solution first: write to us at support@gracelab.io setting out the problem, and we will reply.
Failing agreement, the dispute falls to the competent courts of the publisher's registered office, given in the legal notice, without depriving a consumer of the right to bring the case before the court where they live when the law provides for it.
16.Write to us
For any question about these terms: support@gracelab.io. The publisher's full details are given in the legal notice.
These documents are written and checked in French and in English. The French version is the reference for readers in French-speaking countries; the English version applies everywhere else. Whatever language HelloMe is displayed in, only these two versions are binding.
